Sexually Exploited and Trafficked Youth

In Minnesota, the Safe Harbor law makes sexually exploited youth eligible for intervention under the child protection codes, increases penalties for purchasers and exploiters, and creates a victim-centered, statewide response to aid sexually exploited youth, including ensuring sexually exploited youth are not considered delinquent children or criminals and are viewed instead as victims and survivors. The state also uses the No Wrong Door service model, which makes certain services available to sexually exploited youth under Safe Harbor.
Who qualifies for Safe Harbor?
Anyone aged 24 and under who has engaged in commercial sexual activity.
What is commercial sexual activity?
Commercial sexual activity occurs when anything of value or a promise of anything of value (e.g., money, drugs, food, shelter, rent, or higher status in a gang or group) is given to a person by any means in exchange for any type of sexual activity. A third party may or may not be involved.
What services does Safe Harbor provide?
Under Minnesota Statutes §256K.47, services provided under Safe Harbor may include the following:
assistance in obtaining temporary emergency shelter;
assistance in obtaining food, clothing, medical care, or mental health counseling;
counseling regarding violence, sexual exploitation, substance use, sexually transmitted infections, and pregnancy;
family reunification services;
conflict resolution or mediation counseling;
referrals to other agencies that provide support services to sexually exploited youth and youth at risk of sexual exploitation;
assistance with education, employment, and independent living skills;
aftercare services;
specialized services for sexually exploited youth experiencing homelessness and youth with mental health needs; and
services to address the prevention of sexual exploitation and homelessness.
